Terms and Conditions

The rules governing your use of the Green Wiser App, Green Wiser payment kiosks, and the EV charging payment Services.

1. Definitions and Interpretations

Unless otherwise specified, the following terms have these meanings.

“Application” includes every version (such as updates, upgrades, beta versions, or any combination thereof) of software or programs used for providing the Services in any format, media, or platform. This includes all related websites, micro-sites, mobile apps, computer programs, digital and interactive systems (including both front-end and back-end), and any Derivative Works created from them.

“Derivative Works” are works created from, based on, or derived from existing works, such as modifications, enhancements, compilations, annotations, or translations.

“EV Charging Facilities” refers to locations like carparks, listed periodically by us, that use the Green Wiser App and Services to take payments for EV charging services.

“Green Wiser EV Charging Payment Services” or “Services” means the feature in the Green Wiser App (with or without a payment kiosk) that displays EV charging fees and allows Users to pay those fees after charging their vehicles at an EV Charging Facility.

“Required Information” is the type of personal details you need to provide during registration for Green Wiser App Services. Required Information consists of your name (as shown on your credit card or vehicle registration), email address, mobile phone number, registered license plate (also known as “vehicle registration mark”), Green Wiser App ID (if applicable), and your credit card number, CCV, and expiration date.

“Transaction” refers to a credit card charge for payment of EV charging fees imposed by an EV Charging Facility, and any penalty charges levied by an EV Charging Facility for parking at an EV Charging Station without a reservation, without utilizing the EV charging services, after the completion of an EV charging session, or any combination of the aforementioned actions.

“User” denotes an individual registered to access the Green Wiser App and Services.

Throughout these Terms, “include” and “including” are illustrative and not limiting; “must” or “should” indicates mandatory requirements; references to clauses are to sections of these Terms; and singular words encompass the plural and vice versa.

2. Registration and Activation

The Service is exclusively available to Users who have completed registration. Access is provided through the Green Wiser App and through Green Wiser payment kiosks at certain EV Charging Facilities. Using a Green Wiser payment kiosk requires submission of the Required Information and agreement to these Terms and Conditions, the PICS, and the Privacy Policy.

To register, you must provide the Required Information on the designated registration form and agree to these Terms. By submitting your registration, you confirm that you are the owner or a duly authorized driver of the registered license plate, that you are the holder or a duly authorized signatory of the credit card provided, that all information provided is accurate, complete, and current, and that you will promptly update any previously submitted information should changes occur.

You agree and consent to our passing your registered license plate number to the relevant EV Charging Facilities, receiving your registered license plate number from those facilities, using your credit card information (your name, credit card number, CVC, and expiration date) to share with your credit card company, issuer, or our payment gateway provider to conduct Transactions (credit card information will never be stored by us), using your mobile device identification number to identify you and your activities related to the Transactions and Services, and using your Green Wiser App User identification number to identify you and your car.

Each EV Charging Facility may have separate terms and conditions which you should read carefully. We do not accept any liability resulting from the terms of an EV Charging Facility.

If your Green Wiser App account remains inactive for over 180 days, we may suspend or terminate it. Multiple Users can register the same license plate number, but each User may only have one registered license plate number associated with their Services account at a time.

You are responsible for enabling push notifications on your mobile device and for notifying us of any changes to your Green Wiser App account. Notifications may be sent via push notification or in-app message, and will be considered received by you as soon as they are dispatched. We are not liable for delays or failures beyond our control.

You can request cancellation of the Services anytime through the Green Wiser App, provided there are no outstanding payments. If your Green Wiser App account or Services account remains inactive for over 180 days, we may suspend or terminate it. We reserve the right to cancel, terminate, or suspend the Services at any point without giving reasons.

3. Payment for Transactions

After your payment is processed, the credited amount goes to your card. Payments are final and cannot be refunded or reversed.

We are responsible for calculating Transaction amounts. To use the Service, access Green Wiser services at the EV Charging Facility via the App, use a Green Wiser payment kiosk at the EV Charging Facility if available, or enter your registered license plate number at parking redemption in the Facility. EV Charging Facilities set their own rules and terms. Any charge below 1 kWh will be billed as 1 kWh.

We are not liable for errors or miscalculations in charging fees if the facility operator does not give proper notice about changes to charging fee schedules or to terms and conditions for charging services. For car-parking matters, goods and services (including charging rules and terms), contact the relevant EV Charging Facility.

After each Transaction, you will receive a payment confirmation via push notification, text, in-app message, or a combination. Push notifications must be enabled to receive these records, which are also available in the “History” tab of the Green Wiser App.

Ensure your Registered Payment Method has enough credit before using the Services or paying outstanding amounts. All amounts owed for a Transaction are due immediately. Service usage may be suspended until full payment is made. You may receive payment reminders regarding unsettled amounts through push notification, SMS, or in-app message. If a payment remains unpaid for 15 days, we may terminate the Services.

4. Your Responsibilities

You are required to keep all your information — including the Required Information you have provided — up to date. If there is any change in ownership of the registered license plate number used for the Services, or if the relevant authority revokes your license plate number for any reason, you must apply to cancel the Services accordingly.

You agree to indemnify us against any actions, legal proceedings, liabilities, claims, losses, damages, and reasonable costs or expenses (including legal fees) that may arise due to inappropriate use, misuse, or unauthorized use of the Services or the Green Wiser App.

5. Rules and Restrictions for the Services

If you use the Service, you must adhere to the rules and terms set by the EV charging facility providing the service. Each participating facility may have its own terms and conditions for EV charging services, so please review them carefully and ensure you agree before using those services.

Registration for the Services is limited to one vehicle and its corresponding registered license plate number.

Either we or the operator of the EV Charging Facility may install video cameras at or near the facility. These cameras can be used to record the registered license plate number of vehicles entering the carpark, record the license plate of vehicles using a particular EV charging station, and for general security purposes. Activities within these areas — including yours and those of the public — may be recorded and monitored. Clear notices will be displayed around these cameras. Any use of these cameras will comply with the Personal Data (Privacy) Ordinance (Cap. 486, Laws of Hong Kong) and other applicable laws.

6. Disclaimer of Liability

You acknowledge and accept that operators of EV Charging Facilities are solely responsible for their goods and services, including parking. We are not liable for any aspects of goods or services provided by any EV Charging Facility operator. Each facility has its own usage terms and conditions.

We are not responsible for any misuse or unauthorized use of your registered license plate number, credit card, or both with respect to the Services; you are responsible for any payments arising from such incidents.

To the extent allowed by law, we have no liability — whether under contract (even for intentional breaches), tort (including negligence), or otherwise — for any kind of loss or damage (including consequential, incidental, special, indirect, punitive, or exemplary damages) related to your use of the Services, the Green Wiser App, or any payment kiosk. Where permitted by law, our total liability for any claim relating to this agreement is limited to either the amount of the transaction in question or HK$10, whichever is higher.

7. Personal Information Collection Statement (PICS)

To provide you with the Services, we need to collect, store, process, and use your personal and other necessary information (“Required Information”). Without this, we may not be able to fulfil your request. Required Information includes data such as your device ID, IP address, and domain name gathered during your use of the Services. This information is managed according to these Terms and Conditions, the PICS, and the Privacy Policy.

You agree that we may collect, use, process, retain, disclose, or transfer your information for the following purposes: providing, operating, improving, and personalizing the Services; processing billing, payments, and collection of outstanding amounts; contacting you regarding the Services, transactions, promotions, or offers; responding to your enquiries, claims, or disputes; conducting research, surveys, and data analysis; performing searches with relevant authorities for legal and payment matters; reporting to EV Charging Facility operators and conducting audits; complying with applicable laws; preventing harm and managing claims; supporting due diligence for business transactions; protecting users, maintaining security, and safeguarding rights and property; and fulfilling other legitimate business purposes directly related to the above.

Your Required Information may be shared for the purpose of delivering, maintaining, and operating the Services. This includes: the registered license plate number (shared with EV Charging Facility operators), your Octopus Card number (if registered, for the facilitation and reporting of Transactions), your credit card information (shared with your credit card company, issuer, or our payment gateway provider BBMSL; not stored by us), a token provided by your credit card company or payment gateway provider, information obtained from your credit card company or payment gateway provider necessary to facilitate and report Transactions, and your mobile device identification number.

We will keep your Required Information confidential. We may share or disclose this information under a duty of confidentiality to: your credit card company, issuer, other registered payment service providers (like Apple Pay), or our payment gateway provider (currently BBMSL) — Apple Pay may handle and store personal data in the United States and the Republic of Ireland; our agents or contractors who provide services related to our business operations; and the operators of the EV Charging Facilities.

You have the right to check whether we hold your Required Information and access it, to ask us to correct any inaccurate Required Information, and to learn about our policies and practices regarding the Required Information. We may charge a reasonable fee for providing access. Data access requests should be made in writing to:

8. Amendments

We may change these Terms and Conditions at any time without notice; continued use of the Services means you agree to them.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region of China (“Hong Kong”). Both parties agree that only the courts in Hong Kong have the authority to resolve any disputes or claims — whether related to contracts or not — that come from or relate to these Terms and Conditions, their content, or how they were created.

10. Contracts (Rights of Third Parties) Ordinance

These Terms and Conditions do not grant any rights to third parties, including under the Contracts (Rights of Third Parties) Ordinance (Cap. 623, Laws of Hong Kong). Only permitted assignees or transferees retain their rights under these Terms and Conditions.

11. English Version Prevails

A Chinese translation of these Terms and Conditions has been provided for reference purposes only. In the event of any inconsistency or conflict between the English version and the Chinese translation, the English version shall govern.
